Business Source License 1.1

Parameters

Licensor: nine feet UG (haftungsbeschränkt), Germany (https://9feet.io)

Licensed Work: Sealpixel, in every version the Licensor publishes: the source code, the npm packages under the @sealpixel scope and create-sealpixel-plugin, the Rust crates, the WebAssembly binaries, the documentation and the example projects. The Licensed Work is (c) 2026 nine feet UG (haftungsbeschränkt).

Additional Use Grant: You may make production use of the Licensed Work if you are a Small User. You are a Small User if you are a natural person acting for yourself, or if the organization you act for had less than EUR 1,000,000 of gross revenue in its most recent completed financial year. Revenue is counted across the whole group: the organization, everything that controls it, everything it controls, and everything under common control with it. Where the work is done for a client, the client’s revenue decides.

This Additional Use Grant does not permit offering the Licensed Work, or a work that includes or is derived from it, to third parties as a product or service whose primary purpose is image editing, image cropping, annotation, redaction, watermarking or server-side image rendering.

Change Date: Four years after the date on which the Licensor first publishes a specific version of the Licensed Work.

Change License: Apache License, Version 2.0

Organizations, and anyone who develops with the Licensed Work for an organization, obtain the commercial license this License refers to as developer seats under the Sealpixel Developer Seat License (LICENSE-COMMERCIAL.md).

Notice

The Business Source License (this document, or the “License”) is not an Open Source license. However, the Licensed Work will eventually be made available under an Open Source License, as stated in this License.

Terms

The Licensor hereby grants you the right to copy, modify, create derivative works, redistribute, and make non-production use of the Licensed Work. The Licensor may make an Additional Use Grant, above, permitting limited production use.

Effective on the Change Date, or the fourth anniversary of the first publicly available distribution of a specific version of the Licensed Work under this License, whichever comes first, the Licensor hereby grants you rights under the terms of the Change License, and the rights granted in the paragraph above terminate.

If your use of the Licensed Work does not comply with the requirements currently in effect as described in this License, you must purchase a commercial license from the Licensor, its affiliated entities, or authorized resellers, or you must refrain from using the Licensed Work.

All copies of the original and modified Licensed Work, and derivative works of the Licensed Work, are subject to this License. This License applies separately for each version of the Licensed Work and the Change Date may vary for each version of the Licensed Work released by Licensor.

You must conspicuously display this License on each original or modified copy of the Licensed Work. If you receive the Licensed Work in original or modified form from a third party, the terms and conditions set forth in this License apply to your use of that work.

Any use of the Licensed Work in violation of this License will automatically terminate your rights under this License for the current and all other versions of the Licensed Work.

This License does not grant you any right in any trademark or logo of Licensor or its affiliates (provided that you may use a trademark or logo of Licensor as expressly required by this License).

TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSED WORK IS PROVIDED ON AN “AS IS” BASIS. LICENSOR HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED, INCLUDING (WITHOUT LIMITATION) WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE.

MariaDB hereby grants you permission to use this License’s text to license your works, and to refer to it using the trademark “Business Source License”, as long as you comply with the Covenants of Licensor below.

Covenants of Licensor

In consideration of the right to use this License’s text and the “Business Source License” name and trademark, Licensor covenants to MariaDB, and to all other recipients of the licensed work to be provided by Licensor:

  1. To specify as the Change License the GPL Version 2.0 or any later version, or a license that is compatible with GPL Version 2.0 or a later version, where “compatible” means that software provided under the Change License can be included in a program with software provided under GPL Version 2.0 or a later version. Licensor may specify additional Change Licenses without limitation.

  2. To either: (a) specify an additional grant of rights to use that does not impose any additional restriction on the right granted in this License, as the Additional Use Grant; or (b) insert the text “None”.

  3. To specify a Change Date.

  4. Not to modify this License in any other way.

Developer Seat License

Sealpixel Developer Seat License

Sealpixel is published under the Business Source License 1.1 (LICENSE.md). Its Additional Use Grant covers natural persons acting for themselves and organizations below EUR 1,000,000 of gross annual revenue. Every other production use needs the commercial license that the Business Source License refers to. This document is that commercial license. Everything not covered here follows the Business Source License 1.1.

1. Seats

  • Seats are required once the organization the work is done for reaches EUR 1,000,000 of gross revenue in a completed financial year, counted across its whole group. Below that, no seat is needed.
  • One developer seat is required for every developer who works on a codebase that includes Sealpixel. A developer is anyone who writes, reviews, tests or integrates code in a project that includes Sealpixel, including front-end and back-end developers, designers who work in the codebase, QA engineers, and external freelancers and contractors. People who only use the finished application are not developers.
  • A seat is assigned to a named person. It may be reassigned when that person stops working with Sealpixel; a seat may not be shared by two people at the same time.
  • Seats are bought per organization and cover every product, project, domain and environment of that organization. There is no per-product, per-domain or per-render fee.
  • A freelancer or contractor working for a client above the threshold is covered by a seat of that client, or may hold a personal seat instead. A personal seat covers that person’s work for every client.

2. Price and term

  • 599 EUR per seat per year list price, plus VAT where applicable. Seats bought within twelve months after the 1.0 release cost 499 EUR per seat per year, kept for their renewals. Orders of 5 or more seats get 10 percent off every seat, orders of 10 or more 20 percent. Checkout and invoicing are handled by our merchant of record; enterprise customers may pay by invoice.
  • The term is twelve months from purchase and renews yearly until cancelled. Cancellation takes effect at the end of the current term.
  • Additional seats bought during a term are prorated to the same renewal date.

3. What is included

  • Production use of Sealpixel in every product the organization ships, without the limits of the Additional Use Grant, except that offering Sealpixel itself as a competing image editing product or service to third parties remains excluded.
  • All releases of Sealpixel published during the term, including new plugins, wrappers and fixes.
  • Support by email for developers holding a seat, with a first response within two business days.
  • The right to keep using every release received during the term, forever, in any product the organization ships (perpetual fallback). After the term ends, releases published later, and support, require an active seat.

4. Refund

You may cancel within 30 days of the first purchase for a full refund, no questions asked. Refunds are processed by the merchant of record to the original payment method.

5. Enterprise

On request the licensor offers: source code escrow, custom contract terms, an SLA with defined response times, invoicing with purchase orders, and volume pricing above 25 seats. Contact hello@9feet.io.

6. Verification

The software has no runtime license check and never phones home. The licensor may ask an organization once per year to confirm its number of developers in writing. Undercounting is a violation of this license and of the Business Source License 1.1.

7. Governing law

These terms are governed by the laws of the Federal Republic of Germany. Place of jurisdiction for merchants is Lübeck.
